1. Acceptance of Terms

By accessing or using TMS List (the "Site"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site.

2. Description of Service

TMS List provides a directory of Transcranial Magnetic Stimulation (TMS) providers and educational content related to mental health treatments. We do not provide medical advice, diagnosis, or treatment. The content on this Site is for informational purposes only.

3. No Medical Advice

THE SITE DOES NOT PROVIDE MEDICAL ADVICE. The contents of the Site, such as text, graphics, images, and other material contained on the Site ("Content") are for informational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

4. User Responsibilities

You agree to use the Site only for lawful purposes. You are prohibited from violating or attempting to violate the security of the Site, including, without limitation, accessing data not intended for you or logging into a server or account which you are not authorized to access.

5. Provider Listings and Accuracy of Information

TMS List is a directory. Listings for clinics, doctors and other providers are compiled from publicly available sources, third-party data, and information submitted by providers and users. We make reasonable efforts to keep listings accurate, but:

  • Listing information (including names, credentials, addresses, phone numbers, hours, services, TMS devices, insurance accepted, pricing, ratings and reviews) is provided "as is" and may be incomplete, out of date or inaccurate. We do not independently verify every listing, and a listing is only marked "Verified" where stated.
  • Inclusion of a provider does not imply endorsement, recommendation, referral or any guarantee of quality by TMS List. Rankings, badges and ratings are informational and are not a substitute for your own judgement.
  • You are responsible for confirming a provider's licensure, qualifications, insurance coverage, fees and availability directly with the provider before booking or receiving care.
  • TMS List is not a party to any relationship between you and a provider, and is not responsible for the acts, omissions, advice or care of any listed provider.
  • We may edit, correct, suspend or remove any listing at any time, at our discretion.

Corrections. If you believe information on a listing is wrong, use the "Report incorrect information" link on that clinic or provider profile. Reports are reviewed by our team before any change is made. Providers can also claim their listing to update it directly. Submitting a report does not guarantee that a listing will be changed.

6. Provider-Submitted Content

If you claim, create or edit a listing, you confirm that you are authorised to act for that provider and that the information you submit is accurate, lawful and kept up to date. You are solely responsible for that content, and you grant TMS List a non-exclusive, royalty-free licence to display it on the Site. You agree to indemnify and hold harmless TMS List, its operators and their officers, employees and agents from any claims, losses or expenses (including reasonable legal fees) arising from content you submit or from your breach of these Terms.

7. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT AND LISTINGS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted or error-free.

8. Limitation of Liability

In no event shall TMS List, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site, including any reliance on listing information or any treatment, appointment or other dealing with a provider found through the Site.

9. Changes to Terms

We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them.

10. Subscriptions and Billing

TMS List is operated as a joint venture between MyKohi LLC, a company registered in the United States, and ATZ Medappz Pvt Ltd, a company registered in India. We offer paid subscription plans (Starter, Professional, and Clinic Group) for TMS clinic providers who wish to list their services on the platform.

Subscriptions are billed monthly through Stripe (for international providers) or Razorpay (for Indian providers), at the rates displayed at the time of purchase. All prices are in USD unless otherwise stated.

  • TMS List Starter: $49.00 USD per month
  • TMS List Professional: $99.00 USD per month
  • TMS List Clinic Group: custom pricing, quoted on request
  • Lead CRM add-on: $19.00 USD per month (optional; included with Clinic Group)

By purchasing a subscription, you authorize us to charge your payment method on a recurring monthly basis until you cancel. You may cancel your subscription at any time from your billing portal.

No refunds: Payments are non-refundable. If you cancel, your access will continue until the end of your current billing period. You will not be charged after cancellation.

All payment processing is handled by Stripe Inc. (United States) or Razorpay Software Pvt Ltd (India). TMS List does not store your card details.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
